Under New York’s Anti-Lapse Statute, if a testator (the person who created the Will) leaves a gift to his or her brother, sister or issue (children, grandchildren, etc.) in a Will, and that beneficiary predeceases the testator, the gift passes to the issue of the predeceased brother, sister, or issue.
