Probate
Probate is the term for a legal process in which a Will is reviewed by the court to determine whether it is valid and authentic.
After a person dies, the court appoints either an executor named in the will or an administrator (if there is no will) to administer the process of probate. This involves collecting the assets of a deceased person to pay any liabilities remaining on the person’s estate, and to distribute the assets of the estate to beneficiaries. In New York State, the average time to probate a Will is 7-9 months.
The probate process can cause delays in the time it takes your beneficiaries to receive your gifts. It can also be expensive for your estate to administer. Lastly, probate is a done under court supervision in a public forum and therefore the contents of your Will become public information.

Federal and State Estate Taxes
Although the federal estate tax doesn’t apply to amounts under $11.58 million (as of Jan 2021), states impose different levels of estate tax depending on the size of your state and the state in which you reside. Gregory Law can provide you with several options on how to reduce your estate taxes.
Durable Power of Attorney
A durable power of attorney is a legal document that authorizes a person you have chosen to handle legal or financial decisions on your behalf if you become incapacitated and are unable to make decisions for yourself.
Gregory Law strongly recommends every adult have a durable power of attorney so they can designate someone to handle legal, medical and financial decisions in case of an emergency. If a person has not signed a power of attorney and then becomes incapacitated, their family may be required to ask a court to appoint a guardian to handle decisions. This can often be a timely, complex, and expensive process.
Health Care Directives
Gregory Law can prepare a healthcare directive document naming someone to carry out your healthcare wishes when you are not able to speak for yourself. Other healthcare documents include a HIPAA Authorization and an Addendum to your Advance Directive with additional instructions to your healthcare agent.
